DMCA & Copyright Policy

Zero Hour Patriots respects the intellectual property rights of others and expects the same of everyone who uses zerohourpatriots.com (the “Site”). In accordance with the Digital Millennium Copyright Act of 1998 (“DMCA”), 17 U.S.C. § 512, we respond promptly to clear notices of alleged copyright infringement.

Filing a Copyright Infringement Notice

If you are a copyright owner, or are authorized to act on behalf of one, and you believe that material on the Site infringes your copyright, please send our designated agent a written notice that includes all of the following:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on the owner’s behalf;
  2. Identification of the copyrighted work claimed to have been infringed (or, if multiple works are covered by a single notice, a representative list of those works);
  3. Identification of the material on the Site that you claim is infringing, including the specific URL(s) of each page where it appears, with enough detail for us to locate it;
  4. Your contact information, including your name, mailing address, telephone number, and email address;
  5. A statement that you have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
  6. A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act on the owner’s behalf.

Notices that do not include this information may not be valid under the DMCA, and we may not be able to act on them. Before you send a notice, please consider whether the use may be a fair use (for example, brief quotations used for news reporting, commentary, or criticism).

What Happens Next

When we receive a valid notice, we will act expeditiously to remove or disable access to the material identified, and we will make reasonable efforts to notify the person who provided the material, if applicable. In many cases, we can resolve concerns quickly by removing an image, replacing it, or adding attribution.

Counter-Notification

If you believe material you provided was removed or disabled by mistake or misidentification, you may send a counter-notification to our designated agent that includes:

  1. Your physical or electronic signature;
  2. Identification of the material that was removed or disabled and the location where it appeared before it was removed;
  3. A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification;
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if your address is outside the United States, any judicial district in which Zero Hour Patriots may be found), and that you will accept service of process from the person who provided the original notice or that person’s agent.

If we receive a valid counter-notification, we may restore the material in 10 to 14 business days unless the original complaining party notifies us that it has filed a court action seeking to restrain the alleged infringement.

Repeat Infringers

It is our policy, in appropriate circumstances, to disable or terminate the accounts or access of users who repeatedly infringe the copyrights of others.

Misrepresentations

Under 17 U.S.C. § 512(f), any person who knowingly and materially misrepresents that material is infringing, or that it was removed or disabled by mistake, may be liable for damages, including costs and attorneys’ fees. If you are not sure whether material infringes your copyright, consider consulting an attorney before sending a notice.
